How much in advance should you request your leave?

Most of the time you can find the answer of your company’s internal policy. However, according to the Labour Code, your employer must respond to your leave request at least 15 days before the planned start date. Therefore, you should submit your leave request well in advance.

Who is entitled to holiday, and how many vacation days are granted per year? 

In general, every employee is entitled to 20 vacation days per year, and in some cases the employees may be eligible for additional days. The most common reason to get them is the age. Starting from the age of 25, one extra day is granted every three years. The maximum number of the additional days based on the age is 10, which is granted to employees over the age of 45.

What other reason can I get extra vacation days?

In addition to age-related entitlement, vacation days may be granted for raising children (until it reaches the age of 16), or following the birth of a child (paternity leave, parental leave), other special job categories. Additional vacation days may also be granted in cases such as raising a child with a disability or if the employee has a reduced work capacity (disability status).

Am I entitled to recieve the 100% of my daily wage during holidays in every case?

Not always. During holidays, employees are entitled to get absence pay, what includes your gross daily wage and applicable allowances. In some cases you may only be entitled to a portion of the daily absence pay. For example in the case of paternity leave, beginning from the 6. day your are only entitled for 40% of your absence pay.  For parental leave taken on working days, only 10% of the absence pay is paid.

In what cases am I entitled for unpaid leave?

The Labour code defines specific situations, in which unpaid leave must be granted for employees, other cases the employees must request it in writing at least 15 days in advance It is important to note, that during unpaid leave the social insurance coverage ceases. Furthermore if the duration of the unpaid leave exceeds 30 days the time spent on unpaid leave will not be counted towards the pension fund.

My employer called me back from vacation. Am I entitled to recieve compensation? 

According the Labour Code an already commenced leave can be interrupted in two situations. One of them is the case of an exceptionally important economic interest, or a reason what harms directly and seriously the operation. In such cases the parties needs to agree in write on the replacement of the granted leave. If you had a pre-booked accomodation, or your were abroad, the costs of the accomodation and the return journey needs to be compensated by the employer. The employee needs to prove the extra costs.
